აშშ-ში შემოსვლის რეგულაციები უცხოეთის მოქალაქეებისათვის
‼️ მნიშვნელოვანი სიახლე: აშშ-ის პრეზიდენტის 2021 წლის 21 იანვრის განკარგულების Promoting COVID-19 Safety in Domestic and International Travel თანახმად, 2021 წლის 26 იანვრიდან აშშ-ში საჰაერო გზით მომავალი ყველა მგზავრი ვალდებულია წარადგინოს კოვიდ19 ტესტის ნეგატიური პასუხი, იმისათვის რომ ავიაკომპანიამ მგზავრი დაუშვას რეისზე. ტესტის პასუხი არ უნდა აჭარბებდეს მგზავრობამდე 72 საათს (3 დღეს). გაითვალისწინეთ, რომ შეერთებული შტატებისკენ მფრინავი ავიაკომპანიები არ დაუშვებენ მგზავრებს რეისზე, თუ მათ არ წარადგინეს შესაბამისი ნეგატიური ტესტის საბუთი ან გამოჯანმრთელების ცნობა.
‼️ აშშ კვლავ ძალაში ტოვებს უცხო ქვეყნის მოქალაქეებისათვის ქვემოთ ჩამოთვლილი ქვეყნებიდან ტრანზიტის შეზღუდვას. საქართველოს მოქალაქეები, რომლებსაც არ გააჩნიათ აშშ-ში ლეგალური ბინადრობის უფლება, ისევე როგორც სხვა უცხო ქვეყნების მოქალაქეები, ვერ შეძლებენ აშშ-ის ტერიტორიაზე შემოსვლას, თუ ბოლო 14 დღის მანძილზე იმყოფებოდნენ (თუნდაც ტრანზიტით) ევროპის შენგენის ზონაში, ასევე ბრიტანეთის გაერთიანებულ სამეფოსა და ირლანდიაში, ბრაზილიაში, ჩინეთში, ირანსა და სამხრეთ აფრიკაში. იხილეთ განკარგულების ბმული ქვეყნების ჩამონათვალით, საიდანაც დღევანდელი მდგომარეობით აკრძალულია აშშ-ში უცხო ქვეყნის მოქალაქეების შემოსვლა.
შენიშვნა: საიმიგრაციო ვიზა არ გახლავთ Green Card/ლეგალური ბინადრობის უფლება. შესაბამისად საიმიგრაციო ვიზის მფლობელი საქართველოს მოქალაქე არ დაიშვება აშშ-ში ზემოთ ჩამოთვლილი ქვეყნების გავლით.
Promoting COVID-19 Safety in Domestic and International Travel განკარგულება შენგენის ზონიდან აშშ-ში შემოსვლისას გამონაკლისს უშვებს უცხოეთის გარკვეულ მოქალაქეებზე, მათ შორის აშშ-ის მოქალაქეების არასრულწლოვან ოჯახის წევრებზე, უცხო ქვეყნის მთავრობის წარმომადგენლებზე და მათ ოჯახის წევრებზე, ა.შ. სრული ჩამონათვალი იხილეთ აშშ-ის პრეზიდენტის 2021 წლის 21 იანვრის Promoting COVID-19 Safety in Domestic and International Travel განკარგულებაში.
2020 წლის 22 ივლისს, აშშ-ის სახელმწიფო დეპარტამენტმა ეროვნული ინტერესების სასარგებლოდ (National Interest Exception) გამონაკლისი დაუშვა უცხოეთის გარკვეულ მოქალაქეებზე, რომლებიც აშშ-ში მოემგზავრებიან შენგენის ზონიდან, გაერთიანებული სამეფოსა და ირლანდიიდან. ინვესტორებს, აკადემიკოსებს, სტუდენტებს, სახელშეკრულებო ტრეიდერებს და იმ პირებს რომლებიც ბიზნეს საქმიანობით აშშ-ის ტერიტორიაზე შემოსვლას გეგმავენ, უფლება ენიჭებათ ისარგებლონ გამონაკლისით ეროვნულ ინტერესებში. აღნიშნული კატეგორიის პირები, რომლებიც გეგმავენ აშშ-ის ვიზის აღებას ან უკვე აქვთ მოქმედი ვიზა/ESTA ავტორიზაცია, აშშ-ის ტერიტორიაზე შემოსვლის უფლება ენიჭებათ.
- სტუდენტები, რომლებიც მოემგზავრებიან შენგენის ზონიდან, გაერთიანებული სამეფოდან და ირლანდიიდან, მოქმედი F-1 და M-1 ვიზებით, არ სჭირდებათ საელჩო/საკონსულოსთან დაკავშირება მგზავრობაზე დასტურის მისაღებად.
- სტუდენტები, რომლებიც აპირებენ აშშ-ის ვიზის აღებას, სავიზო სტატუსი უნდა გადაამოწმონ აშშ-ის უახლოეს საელჩო/საკონსულოსთან.
- სტუდენტებს, რომელებიც შეესაბამებიან F-1 და M-1 სავიზო მოთხოვნებს ავტომატურად ეხებათ აღნიშული გამონაკლისი და შეუძლიათ შეუფერხებლად მგზავრობა.
- ინვესტორები, აკადემიკოსები, J-1 ვიზის მქონე სტუდენტები, სახელშეკრულებო ტრეიდერები და ის პირები ვინც ბიზნეს საქმიანობით გეგმავენ აშშ-ის ტერიტორიაზე შემოსვლას, რომელთა ვიზაც გაცემულია პრეზიდენტის პროკლამაციის (9993 ან 9996) გამოქვეყნებამდე, უნდა დაუკავშირდნენ აშშ-ის უახლოეს საელჩო/საკონსულოს და გადაამოწმონ ეხებათ თუ არა მათ აღნიშული გამონაკლისი. იმ შემთხვევაში თუ მათზე დაიშვა გამონაკლისი, ვიზა/ESTA ავტორიზაციით შეუძლიათ აშშ-ის ტერიტორიაზე შემოსვლა.
სახელმწიფო დეპარტამენტი განაგრძობს შენგენის ზონიდან, გაერთიანებული სამეფოდან და ირლანდიიდან მგზავრობაზე გამონაკლისის დაშვებას იმ პირებისთვის, რომლებიც აშშ-ის ტერიტორიაზე ჰუმანიტარული, ეროვნული უსაფრთხოებისა და საზოგადოებრივი ჯანდაცვის მიზნით გეგმავენ მგზავრობას.
პრეზიდენტის პროკლამაციის შეზღუდვებს მიღმა დანარჩენი ქვეყნებიდან მომავალი უცხო ქვეყნის მოქალაქეები ჩვეულებრივი წესით დაიშვებიან ქვეყანაში.

‼️ UPDATE on Information for International Travelers to the United States:
US President issued Executive Order of January 21, 2021, “Promoting COVID-19 Safety in Domestic and International Travel,” according which from January 26 of 2021, all air passengers, entering the United States, are required to present a negative COVID-19 test, taken within 72 hours (3 days) of departure. Airlines must confirm the negative test result for all passengers before boarding. Airlines must deny boarding of passengers if they do not provide documentation of a negative test or recovery.
‼️ The Unites States still maintains entry restrictions for foreign citizens traveling via below noted countries. Georgian citizens, who are not Legal Permanent Residents (LPR) or government officials, as the rest of the foreign nationals, will be suspended the entry into the United States if they were physically present (including for transit purpose) in the following countries: Schengen Zone of Europe, United Kingdom (excluding overseas territories outside of Europe) and the Republic of Ireland, Brazil, China, Iran and Republic of South Africa during the 14-day period preceding their entry or attempted entry into the United States. Note: Immigration visa holders are not considered as the Green Card holders and therefore are NOT exempt from the travel regulations ordered by the President’s proclamation.
The White House Executive Order of January 21, 2021, Promoting COVID-19 Safety in Domestic and International Travel contains multiple exceptions, including LPRs, certain family members of U.S. citizens and LPRs, and individuals seeking entry into or transiting the United States pursuant to A-1, A-2, C-2, C-3 (as a foreign national government official or immediate family member of an official).
On July 22, 2020, U.S. Department of State adopted the National Interest Exceptions for certain travelers from the Schengen Area, United Kingdom, and Ireland. Certain business travelers, investors, treaty traders, academics, and students may qualify for national interest exceptions under Presidential Proclamations (PPs) 9993 (Schengen Area) and 9996 (United Kingdom and Ireland). Qualified business and student travelers who are applying for or have valid visas or ESTA authorization may travel to the United States even as PPs 9993 and 9996 remain in effect following the procedures below.
Students traveling from the Schengen Area, the UK, and Ireland with valid F-1 and M-1 visas do not need to contact an embassy or consulate to seek an individual national interest exception to travel. Students seeking to apply for new F-1 or M-1 visas should check the status of visa services at the nearest embassy or consulate; those applicants who are found to be otherwise qualified for an F-1 or M-1 visa will automatically be considered for a national interest exception to travel.
Business travelers, investors, academics, J-1 students, and treaty traders who have a valid visa or ESTA authorization that was issued prior to PP 9993 or 9996’s effective date or who are seeking to apply for a visa, and believe they may qualify for a national interest exception should contact the nearest U.S. embassy or consulate before traveling. If a national interest exception is approved, they may travel on either a valid visa or ESTA authorization, as appropriate.
The Department of State also continues to grant national interest exceptions for qualified travelers seeking to enter the United States for purposes related to humanitarian travel, public health response, and national security.
U.S. citizens and visitors are recommended to stay home for 7-14 days upon arrival from international travel and monitor the health. Please, check the link with CDC recommendations.
